Platform Principles

1. Definitions

"User" refers to any individual who accesses or uses the SmArt Exhibition platform.

"Artist" refers to a User who uploads and publishes artworks on the platform.

"Content" refers to any artwork, image, text, or material uploaded by Users.

"Platform" refers to the SmArt Exhibition website and services.

2. Acceptance of Terms

By accessing or using the Platform, you agree to these Terms of Service. If you do not agree, you must not use the Platform.

3. Age Restriction

The Platform is intended for users who are at least 16 years of age. By using the Platform, you represent and warrant that you meet this age requirement. If you are under 16, you must have parental or legal guardian consent to use our services.

4. User Responsibilities

Users are solely responsible for the content they upload and share on the Platform.

• Users must provide accurate information when using the Platform.
• Users must not use the Platform for unlawful, abusive, fraudulent, or harmful purposes.
• Users must not upload content that infringes copyright, violates laws, or breaches the rights of third parties.
• Users are responsible for ensuring that their use of the Platform complies with all applicable laws and regulations.

5. User Content and Copyright Responsibility

By uploading any artwork or visual content ("Content") to SmArt Exhibition, you confirm that you are either the original creator of the Content or that you hold all necessary rights, licenses, or permissions required to upload, display, and publish such Content on the Platform.

You are solely responsible for the Content you submit, including its legality, authenticity, and compliance with applicable copyright and intellectual property laws. You confirm that your Content does not infringe upon the rights of any third party.

SmArt Exhibition does not claim ownership over your Content. However, by uploading Content, you grant SmArt Exhibition a non-exclusive, worldwide, royalty-free license to display, present, distribute, and showcase the Content solely for the purpose of operating, maintaining, and promoting the Platform.

SmArt Exhibition reserves the right to remove, restrict access to, or suspend visibility of any Content in the event of a valid copyright complaint, intellectual property dispute, or other legal violation.

6. Prohibited Content

Users are strictly prohibited from uploading content that contains or promotes:

• Pornography or sexually explicit material.
• Hate speech, harassment, abuse, or the promotion of violence and discrimination.
• Graphic violence or illegal activities.
• Content that infringes copyright, trademark, or other intellectual property rights.
• False, misleading, or deceptive claims regarding authorship, ownership, or origin of any artwork or material.

7. Artist Content and Rights

Artists retain their intellectual property rights to their artworks, subject to the rights granted to SmArt Exhibition under these Terms.

The Platform may display, promote, and curate uploaded artworks as part of its public or private exhibition experience, artist pages, collections, and related platform features.

8. Content Moderation

SmArt Exhibition reserves the right to review, moderate, restrict, hide, or remove any content at its sole discretion, including but not limited to cases where such content violates these Terms, applicable laws, or the integrity standards of the Platform.

We may take action with or without prior notice, including removing content, restricting access, or suspending associated accounts.

SmArt Exhibition is not obligated to monitor, review, or verify all user-submitted content. Responsibility for such content remains solely with the user.
